Introduction
Section titled “Introduction”Welcome to FinBrain Technologies. These Terms and Conditions govern your access to and use of the FinBrain website (finbrain.tech), FinBrain Terminal (terminal.finbrain.tech), REST API, Python SDK, MCP integration, and all related services (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Description of Services
Section titled “Description of Services”FinBrain Technologies provides alternative financial data and AI-powered analytics for publicly traded companies, including:
- AI Price Forecasts - Machine learning-based price predictions for stocks, ETFs, cryptocurrencies, and other securities
- Insider Transactions - SEC Form 4 filings data showing executive and insider trading activity
- Congressional Trading - US House Representatives’ stock trading disclosures
- Analyst Ratings - Wall Street analyst recommendations and price targets
- News Sentiment Analysis - AI-driven sentiment scores from financial news
- App Ratings - Mobile app store ratings and review metrics
- LinkedIn Metrics - Employee and follower count data
- Put/Call Ratio - Options market data and ratios
Our Services are provided via REST API, Python SDK, visual Terminal interface, and MCP integration for AI assistants.
Account Registration
Section titled “Account Registration”To access our paid Services, you must:
- Create an account with accurate and complete information
- Maintain the security of your API key and account credentials
- Notify us immediately of any unauthorized use of your account
- Be at least 18 years of age or the age of legal majority in your jurisdiction
You are responsible for all activities that occur under your account.
Subscription and Payments
Section titled “Subscription and Payments”Pricing
Section titled “Pricing”- FinBrain Terminal: $80/month or $800/year
- Terminal + API Access: $160/month or $1,600/year
Billing
Section titled “Billing”- Subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We reserve the right to change pricing with 30 days notice
- Failed payments may result in suspension of access
Cancellation
Section titled “Cancellation”You may cancel your subscription at any time. Access continues until the end of your current billing period.
Acceptable Use
Section titled “Acceptable Use”You agree NOT to:
- Use the Services for any illegal purpose or in violation of any laws
- Redistribute, resell, or sublicense the data without written permission
- Attempt to reverse engineer, decompile, or extract source code
- Circumvent any access controls or usage limits
- Use automated systems to excessively burden our infrastructure
- Share your API key or account credentials with third parties
- Use the data to manipulate markets or engage in fraudulent trading
- Scrape, crawl, or harvest data beyond your subscription limits
Intellectual Property
Section titled “Intellectual Property”All content, data, software, and materials provided through our Services are owned by FinBrain Technologies or our data providers and are protected by intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the data for your personal or internal business purposes only.
Data and Disclaimers
Section titled “Data and Disclaimers”Not Financial Advice
Section titled “Not Financial Advice”The data and predictions provided by FinBrain are for informational purposes only and do not constitute financial, investment, legal, or tax advice.
- AI predictions are probabilistic estimates and may be inaccurate
- Past performance does not guarantee future results
- You should consult qualified professionals before making investment decisions
- We are not a registered investment advisor or broker-dealer
Data Accuracy
Section titled “Data Accuracy”While we strive for accuracy, we do not guarantee that our data is:
- Complete, accurate, or up-to-date
- Free from errors or omissions
- Suitable for any particular purpose
Data is sourced from public filings, third-party providers, and proprietary algorithms. We are not responsible for errors in source data.
No Warranty
Section titled “No Warranty”THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
Section titled “Limitation of Liability”TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINBRAIN TECHNOLOGIES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Trading losses or investment decisions based on our data
- Service interruptions or data unavailability
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
Section titled “Indemnification”You agree to indemnify and hold harmless FinBrain Technologies, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your trading or investment decisions
Third-Party Services
Section titled “Third-Party Services”We use third-party service providers to operate our platform:
- Stripe - Payment processing and subscription management
- Amazon Web Services (AWS) - Cloud infrastructure and hosting
- Google Analytics - Website analytics
Your use of our Services is also subject to the terms and privacy policies of these providers. For details on how we share data with these providers, see our Privacy Policy.
Service Availability
Section titled “Service Availability”We strive for high availability but do not guarantee uninterrupted access. We may:
- Perform scheduled maintenance with reasonable notice
- Suspend services for security or technical reasons
- Modify or discontinue features with notice
Termination
Section titled “Termination”We may suspend or terminate your access if you:
- Violate these Terms
- Fail to pay subscription fees
- Engage in fraudulent or abusive behavior
Upon termination, your license to use the Services ends immediately.
Modifications to Terms
Section titled “Modifications to Terms”We may update these Terms from time to time. We will notify you of material changes via email or through the Services. Continued use after changes take effect constitutes acceptance.
Governing Law
Section titled “Governing Law”These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Dispute Resolution
Section titled “Dispute Resolution”Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.
